HOW TO FILE A CASE
(a)Any person aggrieved by the decision of the Authority shall file a Notice of Appeal and Memorandum of Appeal within 14 days upon receipt or notification of the decision of the Authority.
(b) Upon filing the Memorandum of Appeal and all accompanying documents, the appellant shall serve the Respondents within 14 days.
(c)Any party served with the Memorandum of Appeal shall respond by filing a replying affidavit within 14 days of service
(d) Parties served with the Memorandum of Appeal or notification of the decision,may file a Cross_Appeal within 14 days from the date of service.
(e)The Tribunal may extend the time limit set out if it is satisfied that the circumstances are exceptional
The Competition Tribunal
The CT hears and determines appeals and disputes arising from decisions of the Competition Authority of Kenya
(a)What does the Competition Tribunal do?
This is an Appellate Tribunal established under the Competition Act,No. 12 of 2010 Laws of Kenya.It is charged with hearing and determining appeals and review applications emanating from the decisions of Competition Authority of Kenya.It may also determine other matters arising under the Act or referred to it by a Competent Court of Law
(b)What is the difference between the Competition Tribunal of Kenya and Competition Authority of Kenya?
The Competition Authority of Kenya is a State Corporation established under the Competition Act of Kenya and is charged with promoting and safeguarding competition in the national market and protecting consumers from unfair and misleading market conduct.It is authorized to investigate,prosecute and adjudicate violations under the Competition Act.
The Competition Tribunal hears and determines appeals and applications for review filed by parties aggrieved by a decision of the Competition Authority
