"ANG PEKENG PAGKAMAKABAYAN AY HINDI DAPAT GAMITING PANANGGA SA PANANAGUTAN SA BATAS PARA SA MGA KRIMEN SA SANGKATAUHAN."
Constitutional law book author and legal expert Atty. Jen Reyes, in an interview with Bilyonaryo News Channel, explains:
"Let’s not use fake or pseudo-patriotism to be a shield against legal accountability, especially if it involves the most heinous or gravest crimes, so grave that the international community deemed it imperative to be a positive obligation of all the nations to cooperate in its investigation or prosecution.
Kung para natin sa sole legal basis ng isang pugante na Article 3, Section 2 of the Constitution na maling namang interpretasyon, ikumpara natin ito sa Constitution na nagsasabi under Article 2, Section 2 that we adopt the generally accepted principles of international law.
Ikumpara natin ito sa sarili nating batas, Republic Act 9851, na nag-authorize sa Executive Department na isuko ang isang akusado when he or she is involved in crimes against humanity.
At i-relate natin ito sa customary international law, mga nabanggit ko kanina ang Vienna Convention on the Law of Treaties, at panghuli, the nail in the coffin, ang denial ng temporary restraining order prayer ni Senator Bato sa Supreme Court, ang mismong nagsasabi and it only points these laws and decisions only point to one clear and inevitable conclusion.
The ICC warrants of arrest is legal and it can be implemented before our jurisdiction by the Executive Department since it is a political question.
Hindi ito labanan ng Konstitusyon at international law. Ang kanilang ritmo ay magkaugnay at magkatabi, they are in cadence with one another."
