Gaerlan served as resource speakers during the first 𝘑𝘶𝘥𝘪𝘤𝘪𝘢𝘭 𝘍𝘰𝘳𝘶𝘮 𝘰𝘯 𝘙𝘦𝘤𝘦𝘯𝘵 𝘚𝘶𝘱𝘳𝘦𝘮𝘦 𝘊𝘰𝘶𝘳𝘵 𝘋𝘦𝘤𝘪𝘴𝘪𝘰𝘯𝘴 𝘢𝘯𝘥 𝘓𝘦𝘨𝘢𝘭 𝘐𝘯𝘯𝘰𝘷𝘢𝘵𝘪𝘰𝘯𝘴 𝘈𝘧𝘧𝘦𝘤𝘵𝘪𝘯𝘨 𝘖𝘷𝘦𝘳𝘴𝘦𝘢𝘴 𝘍𝘪𝘭𝘪𝘱𝘪𝘯𝘰 𝘞𝘰𝘳𝘬𝘦𝘳𝘴 on May 4, 2026, at the Consulate General of the Republic of the Philippines in Milan, Italy.
The 𝘑𝘶𝘥𝘪𝘤𝘪𝘢𝘭 𝘍𝘰𝘳𝘶𝘮, which was hosted by the Philippine Consulate General in Milan and the Migrant Workers Office Milan and organized in close coordination with the SC, sought to provide important updates on key legal issues affecting overseas Filipino workers (OFWs) and their families, promote awareness of legal remedies and judicial processes, and encourage greater understanding of legal developments in relevant matters.
As resource speakers, the Justices imparted relevant legal and jurisprudential updates affecting OFWs and their families to the participants.
Justice Lazaro-Javier focused on recent developments in family law, gender protection, and legal safeguards affecting OFWs and their families. She highlighted the persistent challenges faced by OFWs. Emphasizing the unique realities of transnational Filipino families, she stressed that the rule of law must transcend borders to uphold the protection of marriages, safeguard the welfare of children, and preserve human dignity.
The program then turned to one of the most pressing concerns facing OFWs today—illegal recruitment—with Justice Gaerlan shedding light on a crime that continues to prey on the dreams of Filipino workers and their families. He discussed the legal framework governing illegal recruitment, its various forms and constituent acts, and its critical distinctions from estafa and trafficking in persons.
Upon the Philippine Consulate General in Milan’s request and to address the rampant scam operations in Italy that offer asylum to OFWs in exchange for substantial processing fees, Justice Hernando shared his knowledge on the right to seek asylum within the framework of the 𝘜𝘯𝘪𝘷𝘦𝘳𝘴𝘢𝘭 𝘋𝘦𝘤𝘭𝘢𝘳𝘢𝘵𝘪𝘰𝘯 𝘰𝘧 𝘏𝘶𝘮𝘢𝘯 𝘙𝘪𝘨𝘩𝘵𝘴, the 1951 𝘙𝘦𝘧𝘶𝘨𝘦𝘦 𝘊𝘰𝘯𝘷𝘦𝘯𝘵𝘪𝘰𝘯, and the 1967 𝘗𝘳𝘰𝘵𝘰𝘤𝘰𝘭 𝘳𝘦𝘭𝘢𝘵𝘪𝘯𝘨 𝘵𝘰 𝘵𝘩𝘦 𝘚𝘵𝘢𝘵𝘶𝘴 𝘰𝘧 𝘙𝘦𝘧𝘶𝘨𝘦𝘦𝘴

The Migrant Workers Office (MWO) Milan, headed by Labor Attaché Margarita Eugenia F. Victorino-Marquez, welcomed Department of Migrant Workers (DMW) Undersecretary for Foreign Employment and Welfare Services Felicitas Q. Bay and Director for the Office of Legal Services Janine T. Tutanes during their visit to Milan, Italy from 04 to 06 May 2026, in connection with the conduct of the MWO-Supreme Court Judicial Forum and related welfare engagements for Overseas Filipino Workers (OFWs) in Northern Italy.
During the visit, the DMW officials, together with Supreme Court Associate Justices Ramon Paul B. Hernando, Amy C. Lazaro-Javier and Samuel H. Gaerlan, paid a courtesy call on Jim Tito B. San Agustin at the Philippine Consulate General in Milan. The DMW officials likewise joined MWO Milan in a meeting with representatives of Ospedale San Raffaele regarding possible opportunities for the ethical and regulated recruitment of Filipino nurses in Italy.
Undersecretary Bay likewise met with the legal retainers of Post to discuss the status of ongoing illegal recruitment and other OFW-related cases, as well as legal strategies to actively pursue appropriate actions and ensure continued assistance to affected workers. The visit also included hospital and welfare visits to OFWs undergoing treatment and rehabilitation for serious medical and accident-related conditions, where financial assistance and welfare support were extended as part of the continuing assistance efforts of MWO Milan and the DMW for OFWs in vulnerable situations overseas. As part of the visit, Undersecretary Bay also visited for the first time the Migrant Workers Resource Center (MWRC) in Milan, where discussions were held on the upcoming schedule of the Online Language Training Program and other possible training initiatives of MWO Milan and OWWA for the Filipino community in Northern Italy.

In a milestone initiative for Overseas Filipino Workers (OFWs) in Northern Italy, the 𝐌𝐢𝐠𝐫𝐚𝐧𝐭 𝐖𝐨𝐫𝐤𝐞𝐫𝐬 𝐎𝐟𝐟𝐢𝐜𝐞 (𝐌𝐖𝐎) 𝐌𝐢𝐥𝐚𝐧 brought Supreme Court discussions closer to OFWs through a 𝐉𝐮𝐝𝐢𝐜𝐢𝐚𝐥 𝐅𝐨𝐫𝐮𝐦 held on 𝟎𝟒 𝐌𝐚𝐲 𝟐𝟎𝟐𝟔 at the Philippine Consulate General in Milan.
This event is particularly significant as it marks the first legal forum of the Supreme Court PH for Overseas Filipino Workers outside the Philippines. It reflects the shared commitment of Philippine institutions to bring legal awareness and access to justice closer to Filipinos abroad.
Associate Justices Ramon Paul L. Hernando, Amy C. Lazaro-Javier, and Samuel H. Gaerlan led the discussions, focusing on recent Supreme Court decisions, innovations, and jurisprudence affecting OFWs and their families. Topics included international protection, family law and the recognition of foreign divorce decrees, gender and rights protection, and the fight against illegal recruitment.
For many OFWs, these issues reflect real challenges they face while living abroad, from cross-border family concerns to questions on legal status and protection, and risks in recruitment and employment. Through the forum, participants gained a clearer understanding of their rights, available remedies, and the legal protections under Philippine law, alongside recent developments and innovations in the justice system.
The forum was attended by Department of Migrant Workers Undersecretary Felicitas Q. Bay, Undersecretary for Foreign Employment and Welfare Services, and Atty. Janine T. Tutanes, Director of the Office of Legal Services, together with officials of the Philippine Consulate General in Milan, DMW-accredited legal retainers, Filipino community leaders, and OFWs.
Through initiatives like this, MWO Milan continues to bring services, protection, and useful information closer to OFWs. In line with the Department’s commitment as the Tahanan ng OFW, it remains focused on supporting Filipino workers wherever they may be.
