This program explores how artificial intelligence is transforming legal practice, litigation strategy, and judicial decision-making - through the lens of ethical responsibilities. Using current case law, including United States v. Heppner, the session examines how privilege, work product, and confidentiality apply when lawyers and clients use AI tools. It also addresses emerging challenges such as deepfakes, machine-generated evidence, and evolving authentication standards.
Through practical examples - like AI-assisted research and drafting, client use of public chatbots, and courts’ use of AI - you’ll gain insight into how these developments connect to duties of competence, candor, confidentiality, supervision, and more under the Colorado Rules of Professional Conduct.
